According to the Laws of New Mexico and statute 40-11-5 probability of paternity has to be at least 99% and the required paternity index, however, has to be 100:1. Requires genetic testing for named fathers of children born out of wedlock; provides for a genetic testing waiver attachment; provides for exceptions to the right to genetic testing for determining paternity. The Uniform Parentage Act contains the law which the IV-D agency must comply with in the establishment of paternity.  Establishing paternity is necessary for the establishment of child support.  Unless paternity has been previously established, there are no grounds upon which to bring any enforcement action. The parent and child relationship extends equally to every child and to every parent, regardless of the marital status of the parents. (Section 40-11-5 NMSA 1978).  Full faith and credit must be given to a determination of paternity made by another state, whether established through voluntary acknowledgment or through administrative or judicial process.  Putative fathers may initiate paternity actions through the IV-D agency.  The child may be made a party to the action.  If the child is a party and a minor, he will be represented by his general guardian or a guardian ad litem appointed by the court, or both.  The custodian may act as guardian under this section.
